CANCELLATION & REFUND POLICY

  1. 1 INTRODUCTION

    1. (a)
      This document sets out the cancellation and refund policy (Terms) of Billing Car Hire (ABN 68 626 384 049) (referred to in this cancellation policy as ‘Billing Car Hire, ‘we’, ‘us’, or ‘our’). These Terms will apply whenever you make a booking with Billing Car Hire for the rental of a Vehicle (Booking).
    2. (b)
      Please read and understand these Terms before completing your Booking. These Terms will apply to Bookings whether made online through the website, over the phone, or in person. By placing a Booking for the rental of a Vehicle, you acknowledge and agree that you have read and accepted these Terms as well as our Privacy Policy, so please read them carefully.
    3. (c)
      Changes in these Terms will not affect any Bookings made before the date of change; however, it is your responsibility to ensure that you are familiar with the latest version of these Terms at the time you make a Booking.
    4. (d)
      If there is anything you do not understand in these Terms or do not agree with, please do not proceed with your Booking. You may contact us at admin@billingcarhire.com.au with questions.
  2. 2 RENTAL AGREEMENT

    1. (a)
      When you come to collect a Vehicle, Billing Car Hire will require you to sign our further terms for taking possession of a Vehicle (Rental Agreement), which covers additional terms relating to the hire of a Vehicle, including additional fees.
    2. (b)
      Any additional fee estimates displayed on screen at the time of making your Booking are subject to change, and you must review the Rental Agreement upon collection of the Vehicle.
  3. 3 VEHICLE

    1. (a)
      You acknowledge and agree that your Booking is for a category and general type of Vehicle, and the actual Vehicle may vary in colour, size and some functionality.
    2. (b)
      Please notify us prior to making a Booking if you require a specific Vehicle.
  4. 4 BOOKING FEE

    1. (a)
      To rent a Vehicle, Billing Car Hire requires the payment of a Security Deposit. The Security Deposit is due upfront at the time of Booking.
    2. (b)
      Upon return of the Vehicle after the rental period, Billing Car Hire may claim the Security Deposit against any amount owed by you to Billing Car Hire under the Rental Agreement.
    3. (c)
      Billing Car Hire will hold the Security Deposit for approximately two (2) weeks after the return of the Vehicle, until Billing Car Hire is reasonably satisfied that there have not been any infringements, tolls or other costs incurred by you in relation to the Vehicle (Holding Period). If, after the Holding Period, you do not owe any amounts to Billing Car Hire, or if the owing amounts have been claimed from the Security Deposit and there is a remaining amount, then the relevant remaining amount will be paid back to your original payment method.
  5. 5CANCELLATION & REFUNDS

    1. (a)
      Subject to clause 5(b), you may cancel or amend your Booking for any reason by written notice to Billing Car Hire.
    2. (b)
      If the Notice Period, as outlined in column 1 of the table below, is provided, the corresponding Applicable Refund, as indicated in column 2, shall apply:

    7 days + Full Refund If the notice is 7 or more days prior to the rental start date (shown in the booking confirmation and/or Rental Agreement), States Rental will provide you with a full refund of the Security Deposit.
    48 hours + Partial Refund If the notice is 48 hours or more prior to the rental start date (shown in the booking confirmation and/or Rental Agreement), States Rental will provide you with a full refund of the Security Deposit, minus a 50% cancellation fee.
    Less Than 48 Hours No Refund If the notice is less than 48 hours prior to the rental start date (shown in the booking confirmation and/or Rental Agreement), you will not be entitled to a refund of your Security Deposit.
    1. (c)
      For the avoidance of doubt, any credit card surcharges associated with your Booking will not be refunded to you.
    2. (d)
      You acknowledge and agree that the fees and Applicable Refund set out in clause 5(b), represent a genuine pre-estimate of our losses and damages in the event of termination prior to the rental start date.
  7. 6 GENERAL

    1. (a)
      To the maximum extent permitted by law, Billing Car Hire excludes any liability that may arise in connection with a Booking.
    2. (b)
      These Terms are governed by the laws applying in South Australia and each party irrevocably submits to the exclusive jurisdiction of the courts of South Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with these Terms.
